Tim Charlesworth and Kenneth Charette, give joint presentation.

On Tuesday, June 5, FLB attorneys Tim Charlesworth and Kenneth Charette, gave a joint presentation at the Export Breakfast Series, entitled “Exporting to New Markets: Important Legal Considerations.” The series was hosted by The Lehigh University Small Business Development Center (SBDC), Lehigh Export Network (LEXNET), and the World Trade Club of the Lehigh Valley, in order to update business owners and entrepreneurs on important export-related laws which affect their companies.

Mr. Charlesworth and Mr. Charette discussed distribution arrangements and other market-entry strategies, “best practices” to stay up-to-date in the ever-changing world of compliance, and crucial business transaction concepts, such as Litigation versus Alternative Dispute Resolution (ADR), in the context of exports.

Specifically, Mr. Charlesworth presented on concepts such as Export Compliance Plans, Anti-Boycott measures, as well as bribery and ethics in international business. He also addressed the controversial (and evolving) topics of doing business in Cuba, Iran, and Russia for smaller US businesses.

Mr. Charette then navigated the audience through the nuanced key contract terms in the world of international business. He focused primarily on breaking down the elements of some of the most crucial contracting provisions, such as those dealing with warranties, indemnities and limitations of liability. Both emphasized the oft overlooked role documentation plays while pursuing trade opportunities in new markets.
